Rule 120
Computation of prior service period
(1) While calculating the previous service period of the employee, it will be calculated as follows:-
(a) For the purpose of calculation of seniority for promotion, 100% of the period of service previously held in government service or permanent appointment (if interrupted, cut off the interrupted period) and first served in a developmental position, keeping that service uninterrupted and previously in a temporary position for more than one year After serving and keeping that service uninterrupted, the calculation of the previous development or temporary service period of the employees who have been permanently appointed to the Legislature-Parliament service will be done as follows:-
(1) Thirty-three percent for the period of service rendered in gazetted first class (2) Fifty percent for the period of service rendered in gazetted second category (3) Sixty-six percent for the period of service rendered in gazetted third category (4) Seventy-five percent for the period of service rendered in gazetted category and attendant post (b) For the purpose of pension, the period of service previously rendered in government service or permanent appointment (if it is broken in between, the broken period will be deducted) and the service rendered temporarily for a period of one year or more in the general position will be counted as 100%.
(c) Notwithstanding anything written in Clause (b), if the permanent service period of an employee who is compulsorily retired by age limit does not complete the period of service required to receive pension only, he has served continuously towards development before the permanent service and for the purpose of calculating seniority for promotion. If the instrument is attached to the current permanent service, the pension can be granted by adding only the service period required to get the pension.
(2) Notwithstanding anything written in sub-rule (1), if a person who has received gratuity for his previous government service is re-appointed to the position of the Legislature-Parliament service, only if he returns the amount of gratuity previously received, his previous service period will be calculated according to this rule.
(3) Employees who are appointed after the commencement of this regulation shall comply with this regulation within one year from the date of appointmentGym service period should be completed. If the service period is not added within the said period, such service period will not be added later.
(4) According to sub-rule (3), the employee adding the previous service period to the current service shall submit the details of the study leave, extraordinary leave, medical expenses and insurance records taken before adding the service to the civil library. Explanation:- For the purpose of this rule, "Government Service" means Civil Service and Nepal Health Service.
